1. 协议的确认与接受

1.1 本服务条款（以下简称“本条款”或“本协议”）由您（以下简称“用户”或“您”）与上海智站未来机器人有限公司（以下简称“我们”、“公司”或“3devotion”，注册地址：上海市闵行区望汇路260弄5号4层，联系邮箱：[email protected]）共同缔结。
1.2 本协议规制您对 3devotion 平台（包括域名 https://3devotion.com 、相关网页端应用、服务端应用、MCP 协议接口及相关 API，统称“本服务”）的访问与使用。
1.3 当您勾选同意本协议、注册账号、登录、访问或以任何方式使用本服务时，即表示您已阅读、理解并同意接受本条款及《隐私政策》、《可接受使用政策》、《退款政策》等全部关联文件的约束。如果您不同意本条款的任何内容，您必须立即停止使用本服务。

2. 年龄与账户资格

2.1 本平台仅向已满 18 周岁的成年人开放注册。注册或通过应用授权登录时，须主动勾选已满 18 周岁的声明；不要虚报年龄或代未成年人注册。 2.2 平台不开放学生身份或监护人代同意注册流程。年龄声明不要求提交精确生日、证件或儿童姓名，也不等同身份核验。 2.3 如发现未成年人误注册、未经授权消费或儿童个人信息，请通过客服与工单申请核查与删除；退款依退款政策审查，首次联系不要提交儿童敏感信息。

3. 服务内容与账户管理

3.1 服务形态：3devotion 为用户提供包括但不限于手写笔迹绘制（L0/L1墨迹引擎）、数学公式 OCR 识别与渲染、2D/3D 图形与模型交互、场景录制与导出、AI 助手对话解析、MCP 工具接口及团队协作等在线数字化功能。
3.2 账户注册与安全：

• 用户使用真实合法的电子邮箱注册和登录。
• 用户应妥善保管自己的邮箱访问权限、登录会话标识及 API Key（密钥）。任何通过您的账户、会话或 API Key 进行的操作均视为您本人的操作，由您承担全部法律后果。
• 如发现未经授权的账户访问或密钥泄露，您应立即通知 3devotion 采取相应安全措施。
  3.3 API 与 MCP 限制：平台对 API Key 及 MCP 接口设置有速率限制（Rate Limits）及积分消耗规则，用户不得采取逆向工程、分布式请求或自动化并发脚本规避此类限制。

4. 积分、付费服务与云端存储

4.1 1 积分 = US$0.01，用于支付平台数字服务，不可提现、转让或作为投资工具。购买积分永久有效；没有每日赠送或注册赠送积分。新人体验与首充优惠以实际活动页面为准，不等同于现金余额。 4.2 网页、App 和 MCP Agent 的同类功能同价（应用商店充值价格可能因渠道费用而不同）。生成类最低 20 积分，修改与 AI 助手最低 1 积分；视频导出 720p / 1080p / 4K 分别为 5 / 10 / 15 积分，PDF/PPT/Word 2 积分，PNG 单页 1、全部页 2 积分。超出包含规模的模型与云端资源按实际计量收费，操作前以展示的报价、范围与确认规则为准，不承诺固定总价。 4.3 操作先冻结积分，完成后按实际结算，余额不足停止；账单以服务端流水为准。积分可通过一次性积分包（500 / 1,050 / 3,300 / 11,500 积分）购买，或订阅月包：Pro 每月 US$9.99（每月 1,200 积分、优先队列、4K 导出），Max 每月 US$29.99（每月 4,000 积分、优先队列、4K 导出、高级 AI 模型 8 折）。月包每月自动续费，可随时取消；取消后当期不退、当期内照常使用、下期不再扣款。付款由记录商户 Creem 处理。 4.4 已完成服务所消耗的积分不退（法律另有规定除外）。未消耗余额、系统计费错误、未授权交易按退款政策核查，退款不属于积分提现。 4.5 云端存储无免费额度，按实际资源单价 × 2 每日累计、按月结算；仅保存在本机不收云存储费。欠费先提醒，再只读冻结并提供整包下载链接；自欠费通知明确的起算日起满 30 天仍未处理，将清除云端课件与素材。请在期限内下载备份。清除云端数据不代表购买积分到期，也不清除用户设备上的本机文件。执行状态与起算日以账户通知为准。 4.6 调价应在操作前披露，已完成订单按原约定处理，不追溯增加费用。

5. 免费版与广告展示

5.1 用户理解并同意，为支持 3devotion 免费版本的基础设施运营与技术迭代，我们将在免费版用户的界面中展示商业广告（包括但不限于由 Google AdSense 等合作伙伴投放的文字、图片及富媒体广告）。
5.2 用户不得使用任何广告拦截插件（Ad Blocker）恶意篡改或遮挡免费界面的广告展示，亦不得实施虚假点击、诱导点击等作弊行为。若用户不希望浏览广告，可选择订阅月包。

6. 用户内容与知识产权

6.1 用户内容所有权：用户在 3devotion 画布上独立书写、绘制、上传、生成的具有独创性的内容（包括文本、图表、手绘笔迹、导出的教学资料等，统称“用户内容”）的知识产权归用户或原权利人所有。
6.2 平台使用许可：为向您提供本服务（包括跨设备云端同步、多人协同编辑、画布渲染及必要的备份），您授予 3devotion 一项全球范围内、非排他的、免许可使用费的许可，允许我们在为您提供服务所必需的范围内存储、复制、传输、显示您的内容。我们承诺不会公开出售或未经授权向公众广播您的私有内容。
6.3 平台知识产权：3devotion 的软件代码、前端界面设计、墨迹拟合算法、3D 知识库资源、交互动画、商标及商业标识均属上海智站未来机器人有限公司所有或已获得合法授权。未经我们事先书面明确许可，任何人不得对本服务进行反编译、反汇编、反向工程、抓取或衍生开发。

6.4 课件与社区分享：您创作或上传的黑板、课件等内容著作权归您所有。作品默认保存在本机；登录并明确同意云端保存后，平台才为您私有保存与云端备份，自动保存可关闭，同意可撤回；仅当您主动选择「发布到社区」并选择许可方式时，内容才对他人公开，您可随时撤回发布。您授予我们为提供、备份、展示（限于您选择的范围）该内容所必需的非独占、免费许可。我们仅使用汇总统计信息改进产品，未经您单独同意不将您的原始内容用于训练 AI 模型。

7. 人工智能（AI）功能特别条款

7.1 技术中立与概率输出：3devotion 包含的人工智能助手、公式识别、草图生成等功能依托于第三方大模型技术提供服务。AI 模型的输出结果基于概率计算产生，可能存在错误、不完整、时效性滞后、不准确或误导性内容。
7.2 用户自主核实与风险承担：

• 用户明确理解并同意：AI 生成的内容仅供学术探索、参考研究和辅助草图绘制之用，不构成任何专业建议（包括但不限于法律、医疗、金融、工程计算等专业结论）。
• 用户在采纳、发布或将 AI 生成内容用于任何实际决策或商业用途之前，负有完全的独立核实与审查义务，并自行承担因使用 AI 生成内容而产生的一切风险和法律后果。
  7.3 AI 生成标识与素材许可：AI 生成或合成的文字、图片、配音和视频应保留平台提供的标识，不得恶意删除、伪造或隐瞒。发布前由用户核验事实、教材版权及素材许可；不因付费就自动取得第三方教材、人物声音或素材的所有权或无限商用权。用户内容用于内容库回填、平台展示、共享或训练须分别取得单独授权，可撤回。

7.4 非基础模型训练承诺：我们承诺，未经您的明确书面许可，我们不会使用您的专有业务数据或私有黑板内容输入来训练第三方的通用基础大模型。

平台自制的课程库成品课及组件版权归平台所有；解锁仅授予按页面约定在自己的课程、视频中使用、讲课及导出的许可，不得将原始组件单独转售或批量下载再分发。购买内容使用许可不转移著作权。

8. 免责声明与“按现状”提供

8.1 “按现状”及“按可用”：在法律法规允许的最大范围内，本服务均“按现状”（AS IS）和“按现有可用”（AS AVAILABLE）的基础提供。公司明确否认任何形式的明示或暗示的保证，包括但不限于适销性、特定用途适用性、不侵权、无病毒或错误、不中断运行以及数据的绝对安全与准确性。
8.2 不可抗力与网络故障：由于云服务基础设施（如 Cloudflare）、电力供应、骨干网络通信中断、计算机病毒、黑客攻击、政府行为等不可抗力或第三方因素导致的服务暂停或数据丢失，公司在法律允许范围内不承担赔偿责任。

9. 责任限制

9.1 间接损失排除：在法律允许的最大限度内，在任何情况下，上海智站未来机器人有限公司及其董事、员工、关联方或技术提供商均不对任何间接性、惩罚性、附带性、特殊性或后果性的损害（包括但不限于利润损失、商誉损失、数据丢失、业务中断或设备损坏）承担赔偿责任，无论基于侵权、违约还是其他法律理论，即使公司事先已被告知发生该等损害的可能性。
9.2 责任上限（责任封顶）：在任何情况下，公司因本协议或因使用本服务而向您承担的全部累计累计赔偿责任总额，均不超过您在导致索赔的事件发生前十二（12）个月内因使用本服务而实际支付给公司的服务费用总额；若您为免费版用户，则该赔偿责任总额在任何情况下均不超过 100 美元（或等值人民币 500 元）。

10. 用户保证与违规赔偿

10.1 用户向公司保证，其使用本服务的行为以及上传、书写的内容完全遵守法律法规及本协议，不含有违法、侵权、色情、虚假或破坏公共安全的信息。
10.2 若因用户违反法律法规、违反本协议或侵犯任何第三方的合法权益，导致公司面临任何索赔、行政处罚、诉讼仲裁或产生经济损失（包括合理的律师费、诉讼费、调查取证费），用户应当对公司进行全面赔偿并使公司免受损害。

11. 服务的变更、暂停与终止

11.1 公司有权根据业务发展、技术演进或法律合规需要，对本服务的全部或部分功能进行修改、升级、暂时中断或终止。
11.2 若用户违反本协议或《可接受使用政策》，公司有权在不事先通知的情况下，视情节严重程度对违规用户采取警告、限制功能、冻结 API Key、暂时冻结或永久终止账户的措施，且无需向用户退还未消费的费用。

12. 争议解决与法律适用

12.1 准据法：本协议的订立、效力、解释、履行及争议解决，均适用中华人民共和国法律（为本协议之目的，不包含香港特别行政区、澳门特别行政区及台湾地区的法律法规），并排除冲突法规则的适用。
12.2 管辖法院：因本协议引起的或与本协议相关的任何争议、分歧或主张，双方应首先通过友好协商解决；协商不成的，任何一方均应将争议提交至上海智站未来机器人有限公司住所地有管辖权的人民法院诉讼管辖。

13. 条款修改与通知

13.1 公司有权不时修改本条款。修改后的条款一旦在 3devotion 官方网站公布或以其他方式通知即行生效，并取代原条款。
13.2 用户应当定期查阅本条款。若用户在条款修改生效后继续使用本服务，即视为用户完全接受修改后的条款；若用户不同意修改，应立即停止使用本服务。

14. 杂项

14.1 可分性：若本条款中的任何条款被有管辖权的法院认定为非法、无效或不可执行，该条款在必要范围内予以限制或剔除，其余条款依然保持完全的法律效力。
14.2 不弃权：公司未行使或延迟行使本条款项下的任何权利，不构成对该等权利的放弃。
14.3 完整协议：本条款连同《隐私政策》、《可接受使用政策》、《退款政策》及《第三方服务商名单》，构成您与 3devotion 之间关于使用本服务的完整协议。

1. Acceptance of Terms

1.1 These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and Shanghai Zhizhan Future Robot Co., Ltd. ("we", "us", "our", or "3devotion", registered at 4th Floor, Building 5, Lane 260, Wanghui Road, Minhang District, Shanghai, China; Email: [email protected]).
1.2 These Terms govern your access to and use of 3devotion (including https://3devotion.com, web applications, MCP interfaces, and associated APIs, collectively the "Service").
1.3 By accessing, browsing, registering, or using the Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, Acceptable Use Policy, and Refund Policy. If you do not agree, you must immediately cease using the Service.

2. Age and Account Eligibility

Registration is available only to adults aged 18 or over. Confirm this explicitly during email login or application authorization. Do not misstate age or register on behalf of a minor. Student roles and guardian-consent registration are not offered. The declaration does not collect birth dates or identity documents and is not identity verification. Report underage registrations, unauthorized purchases or child data through /support for investigation, deletion and refund review without sending sensitive child information initially.

3. Service Access and Account Security

3.1 Features: Features include low-latency digital inking, handwriting math OCR, 2D/3D geometry interaction, scene recording/export, AI assistant queries, MCP interfaces, and multi-user collaboration.
3.2 Accounts & Keys: You must register with a valid email. You are solely responsible for maintaining the confidentiality of your session tokens and API keys. All actions conducted through your credentials are deemed your own. You must notify us immediately of any suspected unauthorized access.
3.3 Rate Limits: Users must not attempt to circumvent API rate limits, token quotas, or architectural safeguards.

4. Credits, Payments and Cloud Storage

One credit equals US$0.01 in service value, cannot be withdrawn or transferred, and purchased credits do not expire. No daily or registration credits are granted. Web, App and MCP share service pricing; app-store top-up prices may reflect channel fees. Generation starts at 20 credits, modifications/AI assistance at 1. Video export costs 5/10/15 for 720p/1080p/4K; PDF/PPT/Word costs 2; PNG costs 1 per page or 2 for all pages. Additional resources are metered; the displayed quote and server settlement apply. Funds may be reserved then settled; insufficient balance stops operations. Credits are sold as one-time packs (500 / 1,050 / 3,300 / 11,500 credits) or through monthly plans: Pro US$9.99/month (1,200 credits per month, priority queue, 4K export) and Max US$29.99/month (4,000 credits per month, priority queue, 4K export, 20% off premium AI models). Monthly plans renew automatically and can be cancelled anytime; the current period is not refunded, access continues until it ends, and no further charge is made. Payments are processed by Creem, our merchant of record. Consumed service credits are non-refundable except as required by law. Unused balances and billing errors are handled under the Refund Policy. Cloud storage has no free allowance: actual resource price × 2, accrued daily and settled monthly. Arrears trigger notice, read-only freeze and a download link; cloud content is cleared after 30 days from the notified start date if unresolved. Download a backup beforehand. Local-only storage has no cloud fee; cloud deletion does not expire purchased credits or erase local files. Price changes do not retroactively increase completed-order charges.

5. Free Tier and Advertisements

5.1 Users acknowledge that free tier availability is supported by commercial advertising (including Google AdSense).
5.2 Users may not employ ad-blockers to suppress advertisements on the free tier, nor engage in fraudulent or invalid clicks. Users who prefer an ad-free environment may subscribe to a monthly plan.

6. User Content and Intellectual Property

6.1 User Ownership: You retain all intellectual property rights in your original handwritten strokes, formulas, text, and materials created on 3devotion ("User Content").
6.2 License to 3devotion: You grant 3devotion a worldwide, non-exclusive, royalty-free license to host, store, transfer, and display your User Content solely to the extent necessary to deliver the Service to you. We do not sell or publicly broadcast your private content.
6.3 Platform IP: All code, frontend interfaces, ink algorithms, 3D libraries, animations, and trademarks of 3devotion are owned by or licensed to Shanghai Zhizhan Future Robot Co., Ltd. Reverse engineering or scraping is strictly prohibited.

6.4 Courseware and community sharing: you own the boards and courseware you create or upload. They remain local by default and are stored and backed up privately in the cloud only after you sign in and explicitly consent; you may disable autosave or withdraw consent; they become visible to others only if you choose "Publish to community" and select a license, and you may unpublish at any time. You grant us a non-exclusive, royalty-free license only as needed to provide, back up and display (within the scope you choose) that content. We use only aggregated statistics to improve the product and never use your original content to train AI models without your separate consent.

7. Artificial Intelligence (AI) Features Disclaimer

7.1 Probabilistic Outputs: AI assistant and math parsing features utilize third-party large language models. AI outputs are generated probabilistically and may be inaccurate, incomplete, outdated, or misleading.
7.2 User Verification & Risk: AI outputs are provided solely for conceptual reference and study assistance, not professional advice. Users bear full responsibility for independently verifying AI outputs prior to any reliance, application, or publication.
7.3 No Foundation Model Training: We do not use your private blackboard content or prompt inputs to train foundation AI models without your express written consent.

8. Warranty Disclaimer ("AS IS")

8.1 AS IS and AS AVAILABLE: To the maximum extent permitted by applicable law, the Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, error-free operation, or continuous availability.
8.2 Third-Party Disruptions: We are not liable for service interruptions caused by telecommunication outages, Cloudflare edge failures, power disruptions, or force majeure events.

9. Limitation of Liability

9.1 Exclusion of Consequential Damages: To the maximum extent permitted by law, in no event shall Shanghai Zhizhan Future Robot Co., Ltd., its directors, employees, or licensors be liable for any indirect, incidental, special, punitive, or consequential damages (including lost profits, lost data, or business interruption), regardless of the theory of liability.
9.2 Liability Cap: In all events, the total cumulative liability of the company arising out of or relating to the Service shall not exceed the total amount actually paid by you to 3devotion during the twelve (12) months preceding the claim, or one hundred US dollars ($100 USD / equivalent RMB 500) if you are on the free tier.

10. Indemnification

You agree to defend, indemnify, and hold harmless Shanghai Zhizhan Future Robot Co., Ltd. from and against any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or infringement of third-party rights.

11. Suspension and Termination

We reserve the right to suspend or terminate your account or API access immediately and without prior notice in the event of any breach of these Terms or the Acceptable Use Policy, without refund of prepaid fees.

12. Governing Law and Dispute Resolution

12.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China (excluding conflict of laws principles).
12.2 Exclusive Jurisdiction: Any dispute arising out of or in connection with these Terms shall first be resolved through friendly negotiations. If negotiations fail, the dispute shall be submitted to the exclusive jurisdiction of the competent People's Court where Shanghai Zhizhan Future Robot Co., Ltd. is located .

13. Modifications

We may modify these Terms at any time by publishing updated versions on the website. Your continued use of the Service following such revisions constitutes binding acceptance.

14. Miscellaneous

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will continue in full force and effect. These Terms constitute the entire agreement between the parties concerning the Service.

AI Labels and Content Permissions

Retain AI-generated labels on synthetic text, images, speech and video; review facts and third-party copyright before publication. Payment does not grant unlimited rights to third-party materials or voices. Reuse of user works in the content library, public display, sharing and training each requires separate, revocable authorization.

Platform-produced finished lessons and components remain platform-owned. Unlocking grants the disclosed license to use them in your courses, videos, teaching and exports, without transferring copyright. Do not separately resell raw components or bulk-download them for redistribution.
